2. Service Description
2.1 Overview
Kongen Labs provides a commercial API platform that offers computational pattern analysis services. The Service comprises three primary products:
- Logic SDK — LLM reasoning regime detection. Analyses prompts to detect reasoning complexity and optimal resource allocation. Consumes 1 KT per request.
- Pattern Transfer API — Multi-domain pattern matching. Evaluates signal vectors against a reference corpus of patterns from multiple independent domains to provide confidence adjustments. Consumes 50 KT per single request, 40 KT per signal in batch mode.
- MCP Server — Model Context Protocol integration allowing AI assistants and tools to access Kongen Labs scoring capabilities natively. Same cost as REST API (no overhead).
2.2 Service Availability
We aim to provide the Service on a continuous basis but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to scheduled maintenance, infrastructure updates, or circumstances beyond our reasonable control. We will endeavour to provide advance notice of planned downtime through our status page or via email to registered users.
2.3 Service Modifications
We reserve the right to modify, update, or discontinue any aspect of the Service at any time. Material changes that affect your existing usage will be communicated with at least thirty (30) days' notice. We may add new features, products, or endpoints without prior notice.
3. Account Registration and API Keys
3.1 Account Creation
To use the Service, you must create an account by providing accurate and complete registration information. You must be at least eighteen (18) years of age or the age of legal majority in your jurisdiction, whichever is greater. If you are registering on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.
3.2 API Key Security
Upon registration, you will receive one or more API keys for authenticating requests to the Service. You are solely responsible for:
- Maintaining the confidentiality and security of your API keys.
- All activity that occurs under your API keys, whether or not authorised by you.
- Immediately notifying us at [email protected] if you believe your API key has been compromised.
- Rotating or revoking compromised keys without delay using the dashboard or Admin API.
You must not share, publish, embed in client-side code, or otherwise expose your API keys. API keys found in public repositories, client-side applications, or otherwise publicly accessible locations may be revoked immediately without notice.
3.3 Account Accuracy
You agree to keep your account information accurate, current, and complete. We may suspend or terminate accounts with materially inaccurate information.
4. Token Metering and Billing
4.1 Token System
The Service operates on a token-based metering system. Each API request consumes a specified number of Kongen Tokens (KT) based on the endpoint called. Tokens are deducted from your account balance at the time of request processing. If your token balance is insufficient to fulfil a request, the request will be rejected with an appropriate error response.
4.2 Pricing Model
The Service operates on a pay-as-you-go pricing model:
- Free tier: New accounts receive a free allowance of 1,000 Kongen Tokens at no cost. Accounts that begin using Kongen Loop may receive one additional grant of Kongen Tokens, in an amount we set and may change. No credit card is required to create a Free-tier account.
- Usage-based pricing: After free credits are consumed, each Kongen Token costs $0.0007 USD. You are billed monthly based on actual usage.
- Token expiry: Credits ("Kongen Tokens") purchased on a pay-as-you-go basis do not expire and remain available on your account balance until consumed by API usage.
- Enterprise: High-volume customers may negotiate custom pricing, including volume discounts, committed-use agreements, and dedicated infrastructure. Contact [email protected] for details.
| Operation | Token Cost | USD Cost |
|---|---|---|
| Logic Score (prompt analysis) | 1 KT | $0.0007 |
| Transfer Score (cross-domain) | 50 KT | $0.035 |
| Transfer Batch (per item) | 40 KT | $0.028 |
| MCP Tool Call | Same as REST | Same as REST |
Current pricing is displayed on our Pricing page. We reserve the right to modify pricing with at least thirty (30) days' notice. Price changes will take effect at the start of your next billing cycle following the notice period.
4.3 Free Credits
Free credits are granted in up to two stages: an initial grant when your account is created, and a further grant we may provide, once per account, when you first use Kongen Loop. Free credits do not expire but are non-transferable between accounts. Once free credits are exhausted, subsequent API requests will be billed at the standard per-token rate. No credit card is required to use free credits.
4.4 Payment Processing
All payments are processed through Stripe, Inc. ("Stripe"). By adding a payment method, you agree to Stripe's Terms of Service and authorise charges based on your usage. You are responsible for maintaining a valid payment method on file once your free credits are exhausted. We do not store your credit card numbers or banking details directly; all payment information is held by Stripe in accordance with PCI DSS standards.
4.5 Billing Cycle
Usage is metered continuously and billed monthly in arrears. At the end of each calendar month, your total token consumption (minus any free credits) is calculated and charged to your payment method on file. You may view your current usage at any time through the dashboard. You may close your account at any time through the dashboard; final charges for the current billing period will be processed upon closure.
4.6 Failed Payments
If a payment fails, we will attempt to process the charge up to three (3) additional times over a period of fourteen (14) days. If all retry attempts fail, your account may be suspended until the outstanding balance is settled. You remain liable for any outstanding charges.
4.7 Refunds
Usage charges are generally non-refundable, as they reflect services already consumed. We may, at our sole discretion, issue refunds or credits in cases of documented Service outages exceeding our SLA commitments, billing errors attributable to us, or other exceptional circumstances. Refund requests should be directed to [email protected].
4.8 Taxes
All prices are exclusive of applicable taxes unless otherwise stated. You are responsible for all taxes, duties, and levies imposed by your jurisdiction. For customers within the European Union, VAT will be applied in accordance with applicable EU VAT rules. Norwegian MVA (value-added tax) applies to customers located in Norway.
5. Rate Limiting and Fair Use
5.1 Rate Limits
Rate limits are expressed as maximum requests per minute (RPM) and are applied per API key using a sliding window algorithm. Current rate limits are published in our API documentation. Requests exceeding your rate limit will receive an HTTP 429 response. Enterprise customers may negotiate higher rate limits.
5.2 Fair Use
The Service is intended for legitimate commercial and research purposes. We reserve the right to throttle or temporarily suspend access for any account exhibiting usage patterns that we reasonably determine to be abusive, including but not limited to: sustained maximum-rate automated requests without legitimate processing of responses, patterns designed to circumvent rate limits (such as distributing requests across multiple accounts), or usage that degrades the Service for other users.
5.3 Burst Allowances
Short-term burst allowances above the stated RPM limit may be provided on a best-effort basis and are not guaranteed. Sustained usage above your rate limit is not permitted regardless of burst allowance.
6. Acceptable Use
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Violations of the Acceptable Use Policy constitute a breach of these Terms and may result in immediate suspension or termination of your account.
7. Intellectual Property
7.1 Our Intellectual Property
The Service, including all software, algorithms, models, pattern libraries, reference corpora, documentation, APIs, trademarks, trade names, logos, and visual design elements, is the exclusive intellectual property of Kongen Labs or its licensors. These Terms do not grant you any ownership rights in the Service. You receive only a limited, non-exclusive, non-transferable, revocable licence to access and use the Service in accordance with these Terms and your Plan.
7.2 Your Content
You retain all rights, title, and interest in your Content (the data you submit via API requests). By using the Service, you grant us a limited licence to process your Content solely for the purpose of providing the Service to you. This licence terminates when your Content is no longer needed to fulfil the request (see Section 8 — Data Processing).
7.3 Output
You own the Output generated by the Service in response to your API requests, subject to the following limitations: (a) the Output may contain or reflect Kongen Labs' proprietary scoring methodologies, pattern classifications, and structural signatures, which remain our intellectual property; (b) you may not use the Output to reverse-engineer, replicate, or create a competing service based on our algorithms or pattern library; (c) response watermarks embedded in the Output (the kw_ prefix identifiers) must not be removed or altered.
7.4 Feedback
If you provide us with suggestions, ideas, or feedback about the Service, you grant us an unrestricted, irrevocable, perpetual, royalty-free licence to use such feedback for any purpose, including improving the Service, without obligation or compensation to you.
8. Data Processing
8.1 Transient Processing
API request content (the data you send to scoring endpoints) is processed transiently to generate the requested Output. We do not store, log, or retain the content of your API requests beyond the duration necessary to process each individual request. Once the response is delivered, your input data is discarded from processing memory.
8.2 Usage Metadata
We collect and retain usage metadata, including: timestamps, endpoint called, token cost, response status codes, latency measurements, and your API key identifier. This metadata does not include the content of your requests or the specific data in your responses. Usage metadata is retained for billing, rate limiting, abuse detection, and service improvement purposes.
8.3 Data Processing Agreement
For Enterprise Plan customers who require a Data Processing Agreement (DPA) under GDPR or other data protection laws, we offer a standard DPA upon request. Contact [email protected] to request a DPA.
9. Flow — Local-First Application and Third-Party AI Providers
9.1 The Flow Application
Flow is a local-first client application offered by Kongen Labs. Your Flow conversation history — the prompts you enter and the answers you receive — is stored on your device, not on Kongen Labs servers (see our Privacy Policy, §2.7). The Flow client is open-source software released under the Apache License, Version 2.0. Your use of the Flow client source code is governed by that licence, which is provided "as is", without warranties or conditions of any kind, to the fullest extent permitted by applicable law. This is in addition to, and does not limit, the warranty disclaimers and limitations of liability in Section 11.
9.2 Bring-Your-Own-Key Providers
Flow allows you to connect third-party AI providers — such as OpenAI, Anthropic, Google, Mistral, or DeepSeek — using API keys that you obtain from, and hold directly with, those providers ("Provider Keys"). Your relationship with each such provider is solely between you and that provider. You are responsible for:
- Obtaining and maintaining your own account and Provider Key with each AI provider you configure;
- Complying with the terms of service, acceptable-use policies, and usage restrictions of each such provider;
- All prompts, content, and activity you submit to a provider under your Provider Key; and
- All fees, charges, and costs that a provider bills to you for use of your Provider Key. These charges are set and collected by the provider, not by Kongen Labs, and are separate from the Kongen Token metering described in Section 4.
9.3 Direct Transmission to Providers; Independent Controller
When you send a prompt in Flow using your own Provider Key, that prompt is transmitted directly from your device to the AI provider you configured. Kongen Labs is not a party to that call, does not route it, and does not control it. The provider receives your prompt under your own key and account and acts as an independent controller of the content you send it, under its own terms and privacy policy (see our Privacy Policy, §6.2). Kongen Labs does not control, and is not responsible for, how a provider you configure handles, retains, uses, or discloses content sent under your Provider Key. You should review the terms and privacy policy of any AI provider before connecting it.
Separately, and as described in Section 8 and in our Privacy Policy (§2.7), prompt text sent through Flow is also transmitted to Kongen Labs' routing endpoint solely so that we can recommend an appropriate model and token budget for your request. That routing is performed transiently in memory; we do not store, log, retain, or train on the content of your Flow prompts.
9.4 Disclaimer for Provider-Configured Services
To the maximum extent permitted by applicable law, and in addition to the disclaimers and limitations in Section 11, Kongen Labs disclaims all liability for: (a) how any AI provider you configure handles, retains, uses, or discloses content sent under your Provider Key; (b) the availability, performance, accuracy, interruption, or errors of any third-party AI provider; (c) any suspension, termination, rate-limiting, or change to your account or Provider Key imposed by a provider; and (d) any fees, charges, or costs a provider bills to you. Your selection and use of any third-party AI provider is at your sole discretion and risk.
10. Service Level Agreement
10.1 Uptime Commitment
We commit to a monthly uptime of 99.5% ("Uptime SLA"), measured as the percentage of minutes in a calendar month during which the Service is operational and accepting requests. Accounts using only free credits are provided without any uptime commitment.
10.2 Exclusions
The Uptime SLA excludes downtime caused by: (a) scheduled maintenance announced at least 48 hours in advance; (b) force majeure events; (c) failures of third-party infrastructure providers beyond our reasonable control; (d) your own systems, network connectivity, or misuse of the Service; (e) DNS propagation delays.
10.3 Service Credits
If we fail to meet the Uptime SLA in a given calendar month, affected paying customers may request service credits as follows:
| Monthly Uptime | Credit (% of monthly usage charges) |
|---|---|
| 99.0% - 99.49% | 10% |
| 95.0% - 98.99% | 25% |
| Below 95.0% | 50% |
Service credits must be requested within thirty (30) days of the month in which the downtime occurred. Credits are applied to future billing cycles and are not redeemable for cash. Total credits in any month shall not exceed 50% of your monthly usage charges for that month.
10.4 Enterprise SLA
Enterprise Plan customers may negotiate custom SLA terms, including higher uptime commitments, dedicated support channels, and enhanced credit structures. Enterprise SLA terms are governed by separate agreements.
11. Limitation of Liability
11.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
Without limiting the foregoing, we do not warrant that: (a) the Service will meet your specific requirements; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) the Output or scoring results will be accurate, reliable, or suitable for any particular use case; (d) any defects in the Service will be corrected.
11.2 No Financial or Professional Advice
The Service provides computational pattern analysis and scoring. It does not constitute financial advice, investment advice, medical advice, legal advice, or any other form of professional advice. You are solely responsible for decisions made based on Output from the Service. Kongen Labs shall not be liable for any losses, damages, or adverse outcomes resulting from your reliance on Output.
11.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KONGEN LABS, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITY, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED EUROS (EUR 100).
11.4 Statutory Rights
Nothing in these Terms shall limit or exclude liability that cannot be limited or excluded under applicable law, including liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any mandatory consumer protection rights under Norwegian or EU law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Kongen Labs and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your Content; (c) your violation of these Terms or the Acceptable Use Policy; (d) your violation of any third-party rights; or (e) your violation of applicable law.
13. Termination and Suspension
13.1 Termination by You
You may terminate your account at any time by cancelling your subscription through the billing portal and requesting account deletion via [email protected]. Termination takes effect at the end of your current billing cycle. No refunds will be issued for the remaining portion of a billing cycle.
13.2 Termination by Us
We may suspend or terminate your account immediately and without prior notice if: (a) you breach these Terms or the Acceptable Use Policy; (b) your use of the Service poses a security risk to the Service or other users; (c) we are required to do so by law or a binding order from a competent authority; (d) your account has been inactive for twelve (12) consecutive months on the Free Plan; (e) your payment is overdue for more than thirty (30) days.
13.3 Effect of Termination
Upon termination: (a) your API keys are immediately revoked; (b) your access to the dashboard and Service endpoints ceases; (c) any remaining token balance is forfeited; (d) we will delete your account data in accordance with our Privacy Policy, except for records we are required to retain by law (such as billing records for tax purposes). Sections 7, 9, 11, 12, 15, and 16 survive termination.
13.4 Suspension
In cases where termination is not warranted, we may temporarily suspend your access to the Service. During suspension, your subscription remains active but you cannot make API requests. We will endeavour to notify you of the reason for suspension and provide an opportunity to remedy the issue before proceeding to termination.
14. Prohibited Uses
In addition to the Acceptable Use Policy, the following uses of the Service are expressly prohibited:
- Reverse engineering: Attempting to decompile, disassemble, reverse-engineer, or otherwise derive the source code, algorithms, scoring models, or pattern libraries underlying the Service.
- Competitive analysis: Using the Service to build, improve, or benchmark a competing product or service, or to systematically extract scoring methodologies, patterns, or reference data for use outside the Service.
- Circumvention: Attempting to bypass, disable, or circumvent rate limits, token metering, authentication, watermarking, or any other technical measures of the Service.
- Resale without authorisation: Reselling, sublicensing, or redistributing access to the Service or its Output without prior written authorisation from Kongen Labs. Enterprise Plan customers may negotiate resale rights in their agreement.
- Automated scraping: Using automated tools to systematically extract, collect, or harvest data from the Service beyond normal API usage patterns.
- Misrepresentation: Representing Output as originating from a source other than the Service, or removing or altering attribution or watermark identifiers.
15. API Versioning and Deprecation
15.1 Versioning
The Service API is versioned (currently v1). We may release new API versions with updated endpoints, request/response formats, or capabilities. Previous versions will continue to be supported during a deprecation period as described below.
15.2 Deprecation Policy
When an API version is deprecated: (a) we will announce the deprecation at least ninety (90) days before the end-of-life date; (b) the deprecated version will continue to function during the deprecation period; (c) we will provide migration guides and documentation for transitioning to the new version; (d) after the end-of-life date, requests to deprecated endpoints may return errors. Enterprise Plan customers may negotiate extended deprecation periods.
15.3 Breaking Changes
We will avoid introducing breaking changes to a live API version. If a breaking change is unavoidable for security or legal reasons, we will provide as much advance notice as is practical under the circumstances.
16. Governing Law and Dispute Resolution
16.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions. Where applicable, EU regulations (including the General Data Protection Regulation, the Digital Services Act, and the AI Act) apply in addition to Norwegian law.
16.2 Dispute Resolution
Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, it shall be submitted to the exclusive jurisdiction of the courts of Oslo, Norway.
16.3 Consumer Rights
If you are a consumer (an individual acting for purposes outside your trade, business, or profession), nothing in these Terms affects your statutory rights under Norwegian consumer protection law (forbrukerkjopsloven) or applicable EU consumer protection directives. In particular, consumers within the EU have the right to bring proceedings in the courts of their member state of domicile.
17. GDPR Compliance
17.1 Data Controller
Kongen Labs acts as the data controller for personal data collected through the Service (account information, billing data, usage metadata). For details on our data processing practices, please refer to our Privacy Policy.
17.2 Legal Basis
We process personal data on the following legal bases: (a) contract performance — processing necessary to provide the Service; (b) legitimate interest — usage analytics, fraud prevention, and service improvement; (c) legal obligation — tax and accounting records; (d) consent — where specifically requested, such as marketing communications.
17.3 Your Rights
Under the GDPR, you have the right to access, rectify, erase, restrict processing, data portability, and object to processing of your personal data. You also have the right to withdraw consent at any time and to lodge a complaint with a supervisory authority. To exercise your rights, contact [email protected].
18. Modifications to These Terms
18.1 Updates
We may update these Terms from time to time. When we make material changes, we will: (a) update the version number and effective date at the top of this document; (b) notify registered users via email at least thirty (30) days before the changes take effect; (c) post a prominent notice on the dashboard.
18.2 Acceptance
Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of those Terms. If you do not agree to the updated Terms, you must stop using the Service and terminate your account before the effective date.
18.3 Version History
Previous versions of these Terms are available upon request by contacting [email protected].
19. General Provisions
19.1 Entire Agreement
These Terms, together with the Privacy Policy, Acceptable Use Policy, and any Enterprise agreement, constitute the entire agreement between you and Kongen Labs regarding the Service. They supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
19.2 Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
19.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by Kongen Labs.
19.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
19.5 Force Majeure
Neither party shall be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, pandemic, war, terrorism, cyberattacks, power failures, or failures of third-party infrastructure providers.
19.6 Notices
Notices to Kongen Labs should be sent to [email protected]. Notices to you will be sent to the email address associated with your account. Email notices are deemed received twenty-four (24) hours after sending.
19.7 Language
These Terms are drafted in English. In the event of any conflict between the English version and any translation, the English version shall prevail.
